These Terms apply to use of our website and any engagement with Trustify Partners in the absence of a separately executed Service Agreement. By using our website or engaging our services, you agree to these Terms.
Where a Client has a signed Service Agreement, its terms take precedence over these general Terms in any conflict.
Clients agree to: provide accurate role requirements; notify us promptly of any changes; treat all Candidate information as strictly confidential; not approach any introduced Candidate for any other role without our consent; inform us of any offer or acceptance within 48 hours; pay fees on time; and comply with applicable employment law.
If a Client engages a Candidate introduced by Trustify Partners in any capacity within 12 months of introduction, the standard placement fee applies.
By submitting your details, you confirm that all information is accurate; you consent to us holding your data per our Privacy Policy; you consent to your profile being presented to Clients as agreed; you will notify us of any material change in circumstances; and you will not misrepresent your qualifications or right to work.
Trustify Partners acts as an intermediary. We do not guarantee employment outcomes and our engagement does not create an employment relationship with any Candidate.
Fees are set out in the applicable Service Agreement. In the absence of one: contingency and executive search fees are a percentage of gross annual package or fixed amount agreed in writing; volume, RPO, and staffing fees are structured as agreed in writing. All fees exclude applicable taxes.
Overdue amounts accrue interest at 1% per month. An additional late fee of 0.05% per day may apply. We reserve the right to suspend active engagements until overdue amounts are settled.
Fee disputes must be raised in writing within 7 days of invoice. Undisputed portions remain payable by the due date.
The guarantee applies only where: all fees are paid in full and on time; the Candidate's employment is terminated by either party within the Guarantee Period; and we are notified in writing within 7 days of the Candidate's departure.
The guarantee does not apply where departure is due to: redundancy or role change from the Client's business decisions; leave of absence; misconduct by the Client; or the Client's failure to honor the offer letter terms.
Where the guarantee applies, we conduct one replacement search at no additional fee. The replacement search does not extend the original Guarantee Period.
Both parties will maintain strict confidentiality regarding all Candidate information, all Client information, and the existence and terms of any Service Agreement. Neither party will disclose confidential information without prior written consent, except as required by law.
This obligation survives termination of any Service Agreement for 3 years.
During any active engagement and for 12 months after its conclusion, Trustify Partners will not solicit, approach, or recruit any employee of the Client for placement with any other organization, without the Client's prior written consent. This applies to all Client employees at all levels.
All website content is the intellectual property of Trustify Partners. You may not reproduce or distribute it without prior written consent.
Research reports and talent mapping outputs remain our intellectual property until fees are paid in full. Upon full payment, a non-exclusive license to use the materials internally is granted.
Nothing in these Terms limits liability for negligence, fraud, or liability that cannot be excluded by law.
The Client agrees to indemnify Trustify Partners against claims arising from: breach of these Terms; misuse of Candidate information; employment decisions in relation to introduced Candidates; or violation of applicable employment law.
You may use this website for lawful purposes only. You agree not to violate applicable law; transmit unsolicited communications; attempt unauthorized access; or use automated tools to scrape content.
These Terms are governed by the laws of the Socialist Republic of Vietnam. Disputes will first be subject to good-faith negotiation; unresolved disputes may be referred to the competent courts of Ho Chi Minh City.
Where a Client has a Service Agreement specifying a different governing law, those provisions take precedence.
We may update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services constitutes acceptance. Material changes affecting existing engagements will be communicated directly with reasonable notice.
